Florida Abortion Laws after the Election
In the 2024 election, abortion laws were on the ballot in the form of Amendment 4, the Amendment to Limit Government Interference in Abortion. This Amendment, which required a supermajority to pass, was voted down by Florida voters.
What exactly does this mean for abortion rights in the state?
In short, the Heartbeat Protection Act – the existing abortion law of the state – will remain in place. Here’s what you need to know about the Heartbeat Protection Act:
- Abortion is legal in the state of Florida up to 6-weeks gestation for all pregnancies
- Exceptions to the 6-week limit exist in cases of rape, incest, human trafficking, fatal fetal abnormality, or when the pregnant woman’s life is in danger
- The abortion pill must be obtained in person from a medical doctor (not online via mail order).
- Miscarriage care and ectopic pregnancy care are NOT abortions. Women will not be denied medical care for miscarriages or ectopic pregnancies.
Before Scheduling an Abortion
With the current Florida Abortion Law in mind, there are three important factors to consider before scheduling an abortion in the state of Florida:
- Age of the fetus – Since abortion is limited past 6-weeks in the state, the age of the fetus will need to be determined prior to an abortion.
- Pregnancy location – if your pregnancy is located outside of the uterus, known as an ectopic pregnancy, you will need immediate medical care. Ectopic pregnancy care is NOT an abortion, and you will not be denied medical care for an ectopic pregnancy in the state of Florida. It is vital to get healthcare as soon as possible if you suspect an ectopic pregnancy as this can be life threatening.
- Viability – Over 20% of pregnancies end in miscarriage, so it’s important to confirm that you have not miscarried naturally before scheduling an abortion. If the pregnancy has miscarried and is not viable, an abortion will not be necessary.
