How Could the Heartbeat Protection Act Change Abortion Laws in Florida?

The Florida governor’s recent signing of the Heartbeat Protection Act could change Florida’s current 15-week abortion ban to a 6-week abortion ban. If it goes into effect, this would mean women could not obtain an elective abortion in Florida after six weeks.

At the time of writing, Florida’s current 15-week ban on abortion is being challenged in the state’s Supreme Court. If the Florida Supreme Court upholds the current law, the new 6-week ban will go into effect within 30 days of the decision.

What if a Woman Needs an Abortion to Save Her Life?

The Heartbeat Protection Act includes exceptions for women whose lives are endangered due to pregnancy. In these situations, a woman could still get an abortion. Exceptions are also in place for pregnant women as the result of rape, incest, or human trafficking. These women could obtain an abortion until the 15th week of their pregnancies.
